Installation Works – Terms and Conditions

1. Scope of Works

The Contractor shall carry out installation works in accordance with the agreed scope, drawings, and specifications provided at the time of quotation. Any changes to the scope shall be treated as a variation and may result in additional charges and/or time extensions.

2. Client Responsibilities / Site Readiness

The Client shall ensure that the site is fully prepared and ready for installation work, including but not limited to:

Failure to meet these requirements may result in delays, additional charges, or rescheduling.

3. Delays Beyond Contractor Control

The Contractor shall not be liable for delays, lost time, or additional costs arising from circumstances outside their control, including but not limited to:

All such delays shall be chargeable as additional time.

4. Standby Time and Waiting Time

Where work is delayed or prevented due to site conditions or Client-related issues, standby time shall be chargeable at the Contractor’s standard day rate, including labour, equipment, and associated costs.

5. Variations and Additional Works

Any additional work required due to design changes, corrective works, site conditions differing from those specified, relocation or reinstallation of equipment, or incomplete or incorrect preparatory works shall be treated as a variation and charged accordingly.

6. Time Extensions

The Contractor reserves the right to extend the installation period where delays occur due to factors outside their control. This may include additional working days, revised schedules, extended working hours, or overtime charges. Any associated costs shall be payable.

7. Abortive Visits

If the Contractor attends site and is unable to proceed due to site unpreparedness or Client-related issues, the visit shall be chargeable in full, including travel and labour.

8. Overtime and Additional Attendance

Where delays require extended working hours, additional days, or return visits, such time shall be charged at the Contractor’s applicable overtime rate.

Overtime shall be charged per hour at a rate calculated as the Contractor’s standard day rate divided by eight (8), plus fifty percent (50%).

Where delays require additional days or return visits, such time shall be charged at the Contractor’s standard day rate or applicable overtime rates.

9. Installation, Commissioning, and Programming Rates

Installation works are limited strictly to physical installation and connection of equipment as defined in the agreed scope of works and are charged at the Contractor’s standard installation rate.

Commissioning services, including but not limited to system testing, configuration, uploading of a prepared code, calibration, optimisation, performance verification, fault finding, or system adjustments, are expressly excluded from the installation scope unless explicitly stated in writing and shall be charged at the Contractor’s commissioning rate of up to 1.5 times the standard installation rate unless otherwise agreed in writing.

Programming services, including but not limited to software configuration, system integration, custom programming, control logic creation, system functionality changes, or any modification to system behaviour, are expressly excluded from the installation scope unless explicitly stated in writing and shall be charged at a separate rate of up to two (2) times the standard installation rate unless otherwise agreed in writing.

No commissioning or programming services shall be deemed included by assumption, custom, prior practice, site instruction, or expectation unless confirmed in writing by the Contractor.

Any works requested beyond the agreed installation scope shall be treated as additional services and charged accordingly.

10. Acceptance of Terms

Acceptance of the quotation or instruction to proceed confirms acceptance of these terms.
